General Terms and Conditions
These General Terms and Conditions of Booking (hereinafter, the General Terms and Conditions) shall govern the commercial relationships that may arise between AHUMADOS CANARIOS, S.A. with Spanish Tax Code (CIF) A35121912 and the user or client when entering into a contract via the forms that AHUMADOS CANARIOS, S.A. makes available thereto on its website at www.suites1478.com.
Bookings made via the websites of AHUMADOS CANARIOS, S.A. shall imply express acceptance of these terms and conditions by the client or user of the website, as well as the terms and conditions of use established to govern the browsing activity undertaken by the user of the websites owned by AHUMADOS CANARIOS, S.A.
These terms and conditions shall apply without prejudice to the application of those legal regulations governing the specific matter in question.
The General Terms and Conditions of Business govern the remote sales relationship between AHUMADOS CANARIOS, S.A. and the user or client in accordance with the legal stipulations; especially Law 7/1998, of 13 April, on General Terms and Conditions of Business; Law 3/2014, of 27 March, amending the consolidated text of the General Law for the Defence of Consumers and Users; Royal Decree 1906/1999, of 17 December 1999, governing Telephone or Electronic Business with general terms and conditions; Constitutional Law 15/1999, of 13 December, on Personal Data Protection; Law 7/1996, of 15 January, on the Organisation of Retail Trade; and Law 34/2002, of 11 July, on Services of the Information Society and e-Commerce.
AHUMADOS CANARIOS, S.A. reserves the right to make any changes it deems necessary to the content of the General Terms and Conditions without prior notice. Said changes may be made via its websites in any form admissible by law and shall be applicable during such time as they are published on the website and until they are subsequently and validly replaced with others. Nonetheless, AHUMADOS CANARIOS, S.A. reserves the right to apply Specific Terms and Conditions of Business in certain cases with preference over these General Terms and Conditions whenever deemed appropriate, announcing the same in due time and course.
Information prior to the booking
AHUMADOS CANARIOS, S.A. states that the booking process via its websites is duly explained in the corresponding section for formalising the booking.
Furthermore, AHUMADOS CANARIOS, S.A. states that the user may access the terms and conditions of use that can be found on the same website.
When making a booking with AHUMADOS CANARIOS, S.A. via the website thereof, the user or client expressly declares to know, understand and accept said terms and conditions of use and the General Terms and Conditions. Similarly, the user also declares to be of legal age and legally entitled to access the websites of AHUMADOS CANARIOS, S.A. and enter into a contract via the same. The user undertakes to confidentially and responsibly handle the ID and password received when registering as a client, and may not disclose the same to other parties.
After making a booking, the user shall see on-screen confirmation thereof and may print the same by way of a receipt for the booking made. The booking confirmation and booking receipt (printed by the user) shall not be valid as an invoice.
Bookings offer and reference prices
Pursuant to current regulations and especially Law 34/2002, on Services of the Information Society and e-Commerce, AHUMADOS CANARIOS, S.A. offers information on all the possible bookings, the characteristics thereof and the prices thereof in the corresponding section for formalising a booking. Nonetheless, AHUMADOS CANARIOS, S.A. reserves the right to withdraw, replace or change the offers made available to its clients via its website by simply changing the content thereof. Hence, the products and/or services offered at any given time by the website of AHUMADOS CANARIOS, S.A. shall be governed by the General Terms and Conditions in force for each case. Furthermore, the company shall be entitled to cease offering access to the afore-mentioned products and/or services at any time and without prior notice.
Indication of the prices
Each possible booking offered shall be accompanied by the price thereof and whether Canary Islands General Indirect Tax (IGIC) or any other tax is included that may be applicable in each case. The prices shown on-screen shall be valid at the time, with the exception of any typographic error. In the event that the price is different due to the afore-mentioned situation, AHUMADOS CANARIOS, S.A. shall inform the client by email before proceeding to collect payment for the booking.
The availability of the offers provided by AHUMADOS CANARIOS, S.A. via its website may vary according to customer demand. Even though AHUMADOS CANARIOS, S.A. updates the database regularly, the booking requested by the client may not be available at that time. In such cases, AHUMADOS CANARIOS, S.A. shall send an email to the client informing the same of the inability to execute the offer.
AHUMADOS CANARIOS, S.A. requests the details of a credit card owned by the individual making the booking during the booking process on its websites in order to guarantee the effective nature thereof. We remind you that the establishment makes no charges to said credit card when making the booking. The card is merely used as a guarantee. The establishment reserves the right to check the validity of the credit card prior to arrival by the client. The invoice corresponding to the booking shall be settled directly at the establishment, whether in cash, by credit card or by any other payment method accepted by the establishment.
Free cancellation up to 14 days prior to the arrival date. Cancellation up to 7 days prior to the arrival date: 50% of the booking charged to your credit card. No-show or cancellation less than 7 days prior to 14:00 on the arrival date: 100% of the booking charged to your credit card.
Pursuant to Article 103 of Law 3/2014, of 27 March, amending the consolidated text of the General Law on the Defence of Consumers and Users, those supplies of goods or services created according to the specifications of the consumer or clearly personalised or that, given the nature thereof, cannot be returned or may deteriorate or expire rapidly are exempt from withdrawal.
Express consent without sharing clause
Pursuant to the provisions of the current Spanish Constitutional Law on Personal Data Protection and Regulation 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of individuals regarding the processing of personal data and the free circulation of said data:
By signing this document, the interested party grants their consent for their voluntarily provided personal data to be processed by AHUMADOS CANARIOS, S.A., as the owner of Hotel Suites 1478 and the data controller, for the purpose of enabling management of commercial, accounting and administrative relations with customers in terms of all matters related to the services and accommodation at our hotel. The data will be kept for the duration of the administrative and/or commercial relations between the interested party and Ahumados Canarios, S.A. plus the period of time provided for by any specific legislation to which said data may be subject.
For data protection issues, AHUMADOS CANARIOS, S.A. shall be considered as the Data Controller for data files/processes identified in this policy, specifically in the section on data processing.

In the event of a dispute, the parties agree to submit their conflicts to arbitration or ordinary jurisdiction in compliance with the rules on jurisdiction and power in this regard.
